Terms of Service

Agreement

By using x402phone — whether via the API, an AI agent, a script, or any other client — you agree to these terms. If you do not agree, do not use the service.

Service Description

x402phone is a pay-per-call AI phone service. You pay via the x402 protocol (USDC on Base) and we initiate an AI-powered phone call through Bland.ai.

Acceptable Use

You may not use x402phone for:

  • Unsolicited bulk or automated calls (robocalling or spam)
  • Harassment, threats, intimidation, or abusive content
  • Fraud, phishing, impersonation, or deceptive practices
  • Any purpose that violates the TCPA, GDPR, or applicable telecom/privacy law
  • Calls to emergency services
  • Attempting to circumvent rate limits, abuse detection, or payment requirements

You are solely responsible for the content of calls you initiate and for ensuring you have any required consent from the recipient.

Call Recording

Calls are recorded by default. You may disable recording by setting "record": false in your request. You are solely responsible for complying with applicable recording consent laws (including two-party consent jurisdictions). We make no determination of legality on your behalf.

Enforcement

We may suspend or permanently block any wallet address that violates these terms or degrades service quality. Suspensions are at our sole discretion and are not subject to appeal.

Payments

All payments use the x402 protocol in USDC on Base (EIP-155:8453). Payments are final and non-refundable. A failed or incomplete call does not entitle you to a refund.

No Warranty

x402phone is provided “as is” without warranty of any kind. We do not guarantee call completion, connection quality, transcription accuracy, or uptime. Call success depends on carrier routing, recipient availability, and Bland.ai infrastructure — factors outside our control.

Limitation of Liability

To the maximum extent permitted by law, x402phone and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue. Total liability is limited to the amount paid for the specific transaction giving rise to the claim.

Changes

We may update these terms at any time. Continued use of the service after changes constitutes acceptance.
